• Lead counsel for a construction interest in an environmental litigation involving construction of a 31-story office building and contaminated soils.
• Successful establishment of defense environmental non-compliance defense to liquidated damages in multiple construction cases.
• Represented developer in litigation involving groundwater contamination of a shopping center caused by a major oil company.
• Represented developer to enforce environmental indemnity agreement against former owner of solvent contaminated site.
• Successfully defended seller of gas station site from buyer’s claims of non-disclosure and environmental indemnity.
• Represented former owner and operator of a dry cleaning establishment in complex CERCLA litigation.
• Represented tug assist company in ship oil spill on San Francisco Bay involving the ship COSCO BUSAN, successfully exonerating tug owner from any liability under OPA 90 and OSPRA.
• Defense of ship owner in litigation with U.S. Government involving multi-million dollar fines claimed for alleged PCB export disposal issues, resulting in a consent settlement at a small fraction of the alleged claim.
